GENERAL TERMS AND CONDITIONS 

Please note our General Terms and Conditions (GTC) for the water ski and wakeboard camp. 

 

§1) Subject and scope of these General Terms and Conditions 

  1. These general terms and conditions (hereinafter: GTC) regulate the rights and obligations in connection with the registration of events via the "Wakeboard and Water Ski Camp" (hereinafter: WWC)   of the organizer "We" and the participant ( "Them").

  2. Participation can be done online at  www.wasserski-camp.de  to be registered. In addition, we reserve the right to make the offers available on other websites and, above all, as a print version.

  3. Our terms and conditions apply exclusively. We do not recognize any conditions that conflict with or deviate from these General Terms and Conditions unless we have expressly agreed to their validity in writing or in text form.

§2) Registration / participation in Camp 

  1. Participation only comes about through our confirmation to you in text form (e.g. e-mail) after you have entered your registration data in the registration form and clicked the "Send" button or another "Registration button".

  2. By submitting your registration, you accept these General Terms and Conditions. When registering online, you have the option of printing out the text of the contract during the registration process and before the registration is complete.

  3. There is no entitlement to completion of participation in our events. We are free to reject any offer from a user to complete a registration without giving reasons.

  4. The prerequisite for registration is that you are at least 18 years old or, if you are a minor, with the permission/approval of your legal representatives (usually legal guardians).

  5. After registering in writing, each participant will receive a confirmation of registration, usually by email, with more detailed information about the camp or a notification that the maximum number of participants has unfortunately already been reached.

  6. The participation fee is due for payment within 10 days of receipt of the invoice. If the invoice is not paid, the registration will be void and the place will be released again.

  7. If the minimum number of participants of 10 per camp is not reached, the organizer is entitled to withdraw from the contract no later than four weeks before the start of the camp. The participation fee paid will be refunded. There are no further claims.

§3) Our services 

  1. With the WWC we offer you the opportunity to participate in our camps and to book extra services. Registration is online only - via our website https://www.wasserski-camp.de.

  2. The booking is usually made via an extra link that will be sent to you by e-mail prior to invoicing.

  3. Boys and girls from the age of 8 can take part in the wakeboard and water ski camp. The wakeboard and water ski camp is a week camp, ie the participants can arrive on Sunday from 3 p.m. and must be picked up by 12 p.m. on Saturday. During this period, the camp director is responsible for supervision. Registration is only possible via our online registration form. 

§4) Prices 

  1. The prices for the respective camp and extra services can be found directly in the respective offer information on the website or in the printed camp description.

§5) Payment 

  1. All fees incurred are to be paid in advance after invoicing without deduction.

  2. The payment of the camp costs takes place after invoicing and takes place exclusively by bank transfer. 

§6) Obligations of users / participants 

  1. You are obliged to provide truthful information about yourself that you provide when registering for a camp. You also undertake not to pass on your login data and your password to any other person under any circumstances.

  2. The organizer can exclude camp participants from further camp participation who do not follow the instructions of the trainer or supervisor and endanger themselves or others. There will be no refund of participation fees. An exclusion will only take place in consultation with a legal guardian.

  3. The participant or legal representative is liable for damage caused intentionally or negligently. Injuries and illnesses as well as possible consequential damage are to be covered by the statutory or private health and accident insurance of the legal guardians. The organizer cannot be held responsible for this. No liability is assumed for the loss of personal belongings.

§7) Photo and film rights 

  1. By registering, the participants and their legal representatives agree that photos and videos of the participants in which they can be seen may be distributed and publicly displayed, including on the Internet, in connection with the event.

  2. A revocation of the photo approval must be received by us in writing before the start of the camp and is only valid with our written confirmation.

§8) Note on the right of withdrawal - revocation instruction

You have the right to cancel participation in the camp up to eight weeks before the start of the camp without giving a reason.

The revocation period begins on the day of your registration.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw your registration by means of a clear statement (e.g. a letter sent by post, fax or e-mail).

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you revoke your registration, we have to repay all payments that we have received from you immediately and at the latest within four weeks from the day on which we received the notification of your revocation of your registration. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

With your revocation of the registration, all claims against the organizer expire.

§9) Cancellation / Withdrawal 

  1. You can cancel your participation in a camp at any time. Any right of withdrawal (Section §8) remains unaffected. The declaration of withdrawal must be made in writing.

  2. In the event of a cancellation, cancellation costs apply:
    a) If the withdrawal occurs more than eight weeks before the start of the event, no cancellation costs will be incurred.
    b) If you cancel less than eight weeks but more than 21 weekdays before the start of the camp, you must pay 10% of the costs as cancellation costs.
    c) If the cancellation occurs 21 weekdays or less before the start of the camp, 18% of the costs are to be paid by you as cancellation costs.

  3. If necessary, there is the possibility in individual cases that you name a suitable substitute for participation in the event and that a contract change can be made instead of a withdrawal. Please do not hesitate to contact us.

  4. With the cancellation/withdrawal, all claims against the organizer are extinguished.

§10) Disclaimer 

  1. With his registration, the participant assures that there are no health risks that prevent him from participating in the wakeboard and water ski camp.

  2. In the event of any disruptions to performance, the participant is obliged to do everything reasonable to help remedy the disruption and, in particular, to inform the local camp management (trainer) immediately. If a participant violates this obligation, the camp organizer is not liable for the resulting consequential damage.

  3. Participation in the training and the supporting program is at your own risk.

  4. In particular, the participant also bears the risks associated with the type of sport and the use of the sports facility or its equipment, especially when using the features (obstacles - ramps, etc.), workshops, fitness or trampoline. The organizer is not liable for personal injury of the participant.

  5. The participant is not insured through the organizer. Accident or liability insurance is not included in the camp price. It is recommended that participants take out accident insurance with salvage cost coverage, travel cancellation insurance and liability insurance.

  6. The organizer assumes no liability for the participants' sports equipment in the event of destruction or theft. If the participant rents sports equipment, he is responsible for the material. Damages are to be paid in the event of culpable damage or theft.

§11) Force Majeure 

  1. The provider is not liable for events of force majeure that make the agreed service significantly more difficult for the provider of the camp or that temporarily impede or make impossible the proper performance of the services.

  2. All circumstances independent of the will and influence of the providers of the camp, such as natural disasters, government measures, official decisions, blockades, strikes, lockouts and other industrial unrest, confiscation, refusal of service by cooperation partners and sponsors or other circumstances that are unforeseeable, serious and caused by are the providers and enter after registration of the participant. 

  3. If we are prevented from fulfilling our offers due to force majeure, this is not considered a breach of contract, the same applies if we are dependent on the advance performance of third parties and they do not comply with their agreements. 

  4. We will do everything in our power that is necessary and reasonable to reduce the extent of the consequences caused by the force majeure. The participants affected by force majeure will be informed immediately in writing of the beginning and end of the obstacle. 

  5. As soon as it is established that the force majeure lasts longer than one day during the planned stay in the camp, the participant is entitled to terminate the contract by registered letter.

§12) Changes to the terms and conditions 

  1. For changes to services, other adjustments or for the implementation of legal obligations, we reserve the right to change these terms and conditions at any time with effect within the existing camp. We will inform you as a registered user of such changes at least 6 weeks before the changes are scheduled to come into effect. If you do not object within 6 weeks of receipt of the notification and continue to use the services even after the objection period has expired, the changes shall be deemed to have been agreed as effective from the expiry of the period. In the change notification, we will inform you of your right to object and the consequences of an objection. In the event of an objection, we have the right to refuse you to participate in the camp.

§13) Final provision 

  1. The law of the Federal Republic of Germany applies, whereby the validity of the UN sales law is excluded.

  2. If you are a merchant, a legal entity under public law or a special fund under public law, our registered office is the exclusive place of jurisdiction for all disputes arising from the contractual relationship.

  3. Online Dispute Resolution Notice
    The EU Commission provides on the website http://ec.europa.eu/consumers/odr/  the possibility to carry out a complaints procedure for online dispute resolution for consumers (OS). The provider is not obliged to participate in a dispute settlement procedure before a consumer arbitration board. We do not take part in a dispute settlement procedure before a consumer arbitration board.

  4. Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
